Terms of Service

1. Acceptance of Terms

By creating an account, posting a moving job, accepting a job as a driver, or otherwise using the HaulHitch platform (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and HaulHitch.

2. Definitions

• "HaulHitch" or "we" refers to the platform operator and its operators.
• "Mover" refers to a user who posts a moving job seeking a driver.
• "Driver" refers to a user who accepts and transports a posted job.
• "Job" refers to a posted moving request with pickup, dropoff, and load details.
• "Platform Fee" refers to the percentage HaulHitch charges on each completed job.

3. Eligibility & Accounts

You must be at least 18 years old and legally able to enter into contracts to use the Service. You agree to provide accurate, current information during registration and to keep your account credentials secure. You are responsible for all activity under your account.

4. Mover Responsibilities

• Provide truthful and complete job details including pickup location, dropoff location, load size, and pickup date.
• Ensure items are properly packed and legal to transport.
• Be available at the agreed pickup time and location.
• Pay the estimated price through the platform's checkout at the time of posting.
• Understand that the estimated price is calculated by the platform based on distance and load size and may not reflect a negotiated rate.

5. Driver Responsibilities

• Hold a valid driver's license and maintain insurance as required by law for the vehicle used.
• Transport accepted jobs with reasonable care and within the agreed timeframe.
• Complete Stripe Connect onboarding to receive payouts for completed jobs.
• Understand that payouts are processed by Stripe, not HaulHitch, and are subject to Stripe's terms.
• Not accept a job you cannot reasonably complete, and notify the Mover and HaulHitch promptly if circumstances change.

6. Payments & Platform Fee

When a Mover posts a job, the estimated price is charged through Stripe at checkout. HaulHitch collects a Platform Fee of 15% of the job price. The remaining amount is the Driver Payout, which is transferred to the Driver's Stripe Connect account upon successful delivery and confirmation. Movers acknowledge that payments are processed by Stripe and are subject to Stripe's terms and any applicable taxes.

7. Cancellations & Refunds

A Mover may cancel an open job before a Driver accepts it without charge. Once a Driver has accepted a job, cancellation may result in a partial or no refund depending on timing and costs incurred. Refunds, when applicable, are issued to the original payment method through Stripe. Delivered jobs are non-refundable except in cases of documented non-performance.

8. Prohibited Conduct

• Posting false, misleading, or fraudulent job information.
• Accepting payment outside the platform to avoid the Platform Fee.
• Transporting illegal, hazardous, or stolen goods.
• Harassing, discriminating against, or defrauding other users.
• Creating multiple accounts to circumvent restrictions.
• Attempting to reverse-engineer, disrupt, or gain unauthorized access to the Service.

9. Confidentiality

You acknowledge that in the course of using the Service you may be exposed to information about other users, jobs, pricing, or platform operations. You agree not to use, disclose, or exploit any such information for any purpose other than completing a job through the Service. This obligation survives termination of your account.

10. Disclaimers & Limitation of Liability

10.1 Nature of the Service

HaulHitch is a technology platform that connects independent Movers and Drivers. We are not a moving company, motor carrier, freight broker, freight forwarder, warehouseman, or bailee, and we never take possession, custody, or control of any goods. All transportation is arranged directly between the Mover and the Driver as independent parties.

10.2 No Agency, Employment, or Partnership

Drivers are independent contractors, not employees, agents, partners, or representatives of HaulHitch. HaulHitch does not direct or control how a Driver performs a job, including vehicle selection, route, timing, loading, or handling. Neither HaulHitch nor any user has authority to bind the other to any obligation, and no employment, agency, or partnership relationship is created by these Terms.

10.3 No Endorsement or Guarantee

HaulHitch does not endorse any Driver or Mover and makes no promise that a job will be accepted, started, completed, or completed on time. We do not guarantee the accuracy of user-provided information, the condition, safety, or legality of any goods, or the fitness of any vehicle. Any estimated price is an approximation based on data you supply and is not a quote or a guarantee of final cost.

10.4 Assumption of Risk

You acknowledge that moving and transporting goods involves inherent risks, including damage, loss, delay, theft, accident, and personal injury. You voluntarily assume all such risks and are solely responsible for the items you post, accept, or transport. You agree to take reasonable steps to protect your own property, including packing, insurance, and supervision.

10.5 Insurance

HaulHitch does not provide moving, cargo, motor carrier, or any other insurance. Drivers must maintain all insurance required by law for the vehicle used, and Movers are encouraged to obtain their own coverage for their goods. Any insurance a Driver carries is between that Driver and the insurer; HaulHitch has no responsibility under any such policy.

10.6 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, HaulHitch disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant the Service will be uninterrupted, error-free, secure, or that defects will be corrected.

10.7 Limitation of Liability

To the maximum extent permitted by applicable law, in no event will HaulHitch, its operators, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to the Service or any job, whether based on warranty, contract, tort (including negligence), statute, or otherwise. HaulHitch's total aggregate liability for any and all claims arising from or related to the Service is limited to the greater of (a) the Platform Fee HaulHitch collected on the relevant job, or (b) one hundred U.S. dollars ($100).

10.8 Excluded Claims

Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for gross negligence, willful misconduct, or fraud. Where liability cannot be limited, it applies only to the minimum extent required by law.

10.9 Force Majeure

HaulHitch is not liable for any failure or delay caused by circumstances beyond its reasonable control, including acts of God, severe weather, pandemics, strikes, fuel shortages, transportation disruptions, government action, or failures of third-party services such as payment or mapping providers.

10.10 Claims Limitation Period

You must bring any claim against HaulHitch within one (1) year after the event giving rise to the claim, regardless of when you discover it. Claims not brought within this period are permanently barred.

10.11 Dispute Resolution & Class Action Waiver

Any dispute arising from the Service will, where permitted by law, be resolved through binding individual arbitration rather than in court, and you waive any right to participate in a class, collective, or representative action or proceeding. You and HaulHitch each agree to arbitrate solely on an individual basis and that no dispute may be brought as a class or consolidated action.

11. Indemnification

You agree to indemnify and hold harmless HaulHitch from any claims, damages, or expenses arising from your use of the Service, your breach of these Terms, or your violation of any law or the rights of another user.

12. Term & Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct we believe harmful to the Service or its users. Upon termination, the provisions that by their nature should survive will remain in effect, including confidentiality and payment obligations.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the Service, and continued use after the effective date constitutes acceptance of the updated Terms. The version number and acceptance date are recorded on your account.

14. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which HaulHitch operates, without regard to conflict-of-law principles. Any dispute will be resolved through binding arbitration where permitted by law.
